If the Clauses which I have recommended from the Indian Code as to Execution, should be adopted the Provisions as to Foreign Attachment might perhaps be considerably shortened; as for instance by providing simply that when the Plaintiff has established his case and obtained Judgment Execution may issue against any Property of the Defendant in the Colony as upon Ordinary Judgments and that all Garnishees served with Writs of Foreign Attachment may be dealt with as Garnishees under the Clauses relating to Attachment of Debts and those relating to Execution generally.
Section 202.
This is a new Clause. I inserted it in my original Draft, with the view of quieting the apprehensions of Garnishees. If Sections 246-247 of the Indian Code are adopted it might be omitted.
